Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Prism ("we," "us," or "our") governing your access to and use of the Prism platform, website, and mobile application (collectively, the "Service"). By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Age Requirement — Adults Only

You must be at least 18 years of age to create an account or use Prism. By registering, you represent and warrant that you are 18 or older. We take age compliance seriously:

• We will immediately terminate any account we reasonably believe belongs to a minor.
• If you are a parent or guardian and believe a minor has accessed the Service, contact us immediately at the address below.
• We comply with the Children's Online Privacy Protection Act (COPPA) and do not knowingly collect personal information from anyone under 18.

3. Adult Content Policy

Prism is an adult platform intended for users 18 and older. The following applies to all user-generated content ("UGC"), including profile photos, messages, and any other material you share:

• Permitted: Sexually explicit content between consenting adults, provided all individuals depicted are 18 or older and have consented to the creation and sharing of such content.
• Your responsibility: By uploading explicit content, you represent and warrant that every person depicted is (a) at least 18 years of age, and (b) has given their explicit, informed consent to be depicted and to have the content shared on this platform.
• Record-keeping: We reserve the right to require age and consent verification in accordance with applicable law.

4. Strictly Prohibited Content and Conduct

The following are absolutely prohibited and will result in immediate, permanent account termination and may be reported to law enforcement:

• Child Sexual Abuse Material (CSAM): Any depiction, solicitation, or distribution of sexual content involving minors is strictly prohibited and will be immediately reported to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement authorities.
• Non-consensual intimate imagery (NCII): Sharing, threatening to share, or soliciting intimate images of any person without their explicit consent is prohibited.
• Impersonation: Creating an account using another person's identity, photos, or information without their consent.
• Harassment and threats: Sending unsolicited explicit content, threatening messages, stalking behavior, or any communications intended to intimidate, coerce, or harm another user.
• Solicitation of minors: Any attempt to communicate with, groom, or solicit anyone under 18 for any purpose.
• Illegal activity: Using the Service to facilitate prostitution, human trafficking, drug sales, or any other illegal activity.
• Spam and fraud: Creating fake profiles, sending automated messages, or using the platform to defraud other users.

5. User-Generated Content and License

You retain ownership of the content you post. By uploading content to Prism, you grant us a non-exclusive, royalty-free, worldwide license to store, display, and transmit your content within the Service solely for the purpose of operating and improving the platform. This license ends when you delete your content or account.

You are solely responsible for the content you share. We do not pre-screen UGC but reserve the right to remove content that violates these Terms.

6. Safe Messaging and Interactions

• Always obtain clear, ongoing consent before sharing explicit content with another user.
• Respect the right of any user to withdraw consent or block communication at any time.
• Do not use messages to coerce, threaten, or pressure other users.
• You can block or report any user directly from their profile or conversation.
• If you encounter any content or conduct you believe violates these Terms, please report it through the app.

7. Privacy and Location Data

Your use of Prism is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Location access is optional and used only for distance-based profile sorting. We do not share precise location data with other users.

8. Account Termination

You may delete your account at any time through the app. We may suspend or terminate your account at our sole discretion, without notice, if we determine you have violated these Terms. Upon termination:

• Your profile, photos, and messages will be permanently deleted.
• A minimal audit record (email, join date, deletion date, ToS acceptance timestamp) is retained for up to 7 years for fraud prevention and legal compliance.
• If your account is terminated for a violation involving CSAM or NCII, additional records may be retained as required by law enforcement.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not verify the identity, age, or intentions of users beyond the measures described herein. You interact with other users at your own risk. We strongly encourage safe practices when meeting anyone from the internet in person.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRISM AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING FROM YOUR USE OF THE SERVICE OR INTERACTIONS WITH OTHER USERS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

11. Indemnification

You agree to indemnify and hold harmless Prism and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from (a) your use of the Service, (b) your UGC, (c) your violation of these Terms, or (d) your violation of any rights of another person or entity.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts.

If you are located outside the United States, you agree that your use of the Service is subject to California law and you waive any objection to jurisdiction or venue in San Francisco County.

13. International Users

Prism is operated from the United States. If you access the Service from outside the United States, you do so at your own initiative and are solely responsible for compliance with local laws. Adult content platforms may be restricted or illegal in certain jurisdictions. By using the Service from outside the US, you represent that such access is lawful in your jurisdiction.

14. Changes to Terms

We may update these Terms at any time. If we make material changes, we will notify you via the app or email at least 14 days before the changes take effect. Continued use of the Service after changes constitutes acceptance of the revised Terms. If you do not agree with revised Terms, you must delete your account before the effective date.
